On May 21, 2024, the Law of the Republic of Kazakhstan "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Issues of Communication, Digitalization, Improvement of the Investment Climate, and Elimination of Excessive Legislative Regulation" was adopted.
This Law introduces amendments to the Law of the Republic of Kazakhstan "On Informatization" regarding the recognition of the simple electronic signature, i.e., not a digital signature.
✍️ One of the key changes is the recognition of the simple electronic signature (SES), alongside the digital signature. Now, private entrepreneurs have the right to use SES when interacting with foreigners and foreign companies (clause 20-1 of the Law). Contracts signed with such a signature will be equated to paper documents, except for transactions requiring notarization or state registration.
Conditions for using SES:
- A written agreement between the parties on the application of SES.
- Recognition of the authenticity and validity of transactions concluded using SES in written form.
This innovation legitimizes the use of services such as Adobe Sign for signing contracts, except in cases of mandatory registration or notarization (for example, real estate transactions). You can connect to the system for free.
